The Waubay City Council met April 7, 2014 at City Hall at 6:30pm. Mayor Jens presided with Councilmembers Berger, Grebel, Koepp, Moen, Rumpza in attendance. Others attending: Donna Leimkuhl, Dwayne and Dorothy Eidet, Curt Koepp, Erika Welch, Curtis Neilan, Kathy Meland, Rosanne Bisgard, Mary Hoines, Tom Sannes.

Motion to approve minutes from March 3, 2014 was made by Koepp, second by Rumpza, motion carried.

Library reported 355 visitors, 165 VHS tapes sold, 17 kids participating in spring reading program. A request to participate in ebook program through State Library for a cost of $600.00 a year, with Library Board and American Legion willing to split cost with City was discussed. Motion to approve participating in ebook program, cost sharing with Library Board and American Legion, was made by Grebel, second by Rumpza, motion carried. Motion to approve report was made by Grebel, second by Rumpza, motion carried.

Maintenance department reported 12 new water meters ordered, 26 meters repaired, lift station 4 pumping extra hours, new lawn mower delivered, safety equipment came, need to make repairs to skidsteer and payloader as soon as possible. Motion to send Neilan to safety training class in Sisseton April 24 was made by Berger, second by Moen, motion carried. Discussion held on damage to shop roof from big winds last week. Will obtain estimate for repairing. Motion to approve report was made by Moen, second by Berger, motion carried.

Motion to approve payment for the following bills totaling $37,530.12 was made by Grebel, second by Berger, all voting aye, motion carried. Invoices from DrainMan Inc. totaling $1775.51 were reviewed. Motion to authorize half payment for work attempted to be completed but not accomplish by DrainMan Inc. was made by Grebel, second by Moen, all voting aye, motion carried.

Net payroll for March totaled $5921.84; Library $1072.36, Financial Admin. $1900.40, Utilities Dept. $2949.08.

HMGP expenses totaled $56,207.63.

Mayor Jens reported School Board approved school to be designated summer and winter storm shelter for Waubay.

Street Repair – County will measure streets and prepare estimate for chip sealing streets on east side of town. Will contact Climate Control for estimate for dust control for gravel streets.

Lift Station Improvement Project – Motion to approve pay request 5 in amount of $9843.89 to Quam Construction pending funding agency approval was made by Koepp, second by Berger, all voting aye, motion carried. Met with Harry’s Elite today concerning East Lakeshore Drive. Will send pricing information to City.

FEMA Improved Project – Met with representatives in March concerning options available, need archaeological survey completed. Motion to approve Prairie Lakes Archaeological Services to conduct survey in the amount of $1650.00 was made by Grebel, second by Moen, all voting aye, motion carried.

Community Access Grant – Engineer Mohror met with Chuck Fromelt to see if the County could repair three soft areas on Main Street. These repairs will need to be done before paving occurs. Fromelt said County was not equipped to do this kind of work. Mayor Jens will meet with Commissioners to see if they would help financially with repairs as Main Street is part of Day County 1.

One application was received for the Summer Rec Director position. Motion to offer the position to Joel Eisenbraun for $1000.00 was made by Berger, second by Rumpza, all voting aye, motion carried.

Waubay Community FunFest will be held July 18, 19, 20. The next meeting will be April 22, chairpersons are Staci Rumpza and Pam Holmes, some activities being planned are car and tractor show, parade, Church Service, fundraiser meals, ball tournaments.

Motion to advertise for sealed bids for Lakewood Cemetery care was made by Moen, second by Rumpza, all voting aye, motion carried. Bids due by May 2 and will be opened at May meeting. Run ad in Waubay Clipper April 12, 19, 26.

Spring cleanup will be May 12 – 16. Discussion held on enforcing items being sorted as noted on posters. Will either charge to sort items or just not pick up. Notices will be posted and sent out in water billings.

Motion to approve the 2013 Drinking Water Report and publish in Waubay Clipper was made by Moen, second by Grebel, all voting aye, motion carried.

Motion to approve engagement letter from Eide Bailly was made by Koepp, second by Berger, all voting aye, motion carried. Estimated cost of audit is $12,750.00.

HMGP – Motion to approve an automatic supplement in amount of $56,207.63 was made by Grebel, second by Rumpza, all voting aye, motion carried. Attorney Sannes read the Resolution of Intent to Graze and advised the City to pass the resolution and hold a public hearing at the May meeting. He advised grazing will alleviate upkeep and mowing of these lots, but could have many issues. He also suggested the possibility of de-annexing this area. Motion to approve the Resolution of Intent to Graze and hold public hearing on May 5, 2014 at 8:15pm was made by Grebel, second by Koepp, all voting aye, motion carried, resolution as follows:

           

            WHEREAS, the City Council of the City of Waubay, Day County, South Dakota, having been made aware of the extensive flooding to the city limits of Waubay, and

            WHEREAS, the City of Waubay having participated in the HMGP Program with the Federal Government, Sate of South Dakota, and the residents of Waubay, and

            WHEREAS, the City of Waubay has obtained possession of numerous tracts of real estate within the City of Waubay, and

            WHEREAS, due to Federal regulations, these real estate tracts can no longer have permanent structures placed upon them, and

            WHEREAS, the Waubay City Council has an obligation to its citizens to maintain the financial stability of the City, and

            WHEREAS, the City has been approached by individuals who have expressed an intent and desire to graze these real estate tracts which have limited use to the City, and

            WHEREAS, the City Council being aware of its’ ordinances restricting feedlots, stock yards, and potentially the grazing of livestock within the City of Waubay, and

            WHEREAS, the City of Waubay having studied the situation and determined that a need exists for an exception to the City Ordinances for city owned property which was obtained as a result of HMGP Program, and

            WHEREFORE, the City Council having been fully advised in the premises and good cause having been shown and now appearing,

            NOW, THEREFORE, it is hereby ordered by the City Council of the City of Waubay, Day County, South Dakota, that a public hearing shall be held on Monday, May 5, 2014, at 8:15pm at City Hall to address a Resolution to allow the City to enter into written lease agreements for the grazing of sheep, horses, goats, and/or donkeys on City owned HMGP property. That said lease would be a three (3) year lease allowing grazing from April 1st through October 31st each year. That the lessee would be responsible for noxious weed control and installing of fences appropriate for livestock of this nature. Barbed wire fencing would not be allowed and the fencing could not be of a permanent nature. The City specifically prohibits the grazing of cattle and pigs within these properties.

Surplus Lots – Attorney Sannes advised Council to delay auction set for April 26 to sell surplus lots. Will set new date at May meeting.

Three building permits were reviewed with Zoning Administrator Koepp. Motion to approve permit for Roger Johanning pending publication by Moen, second by Rumpza, motion carried. Motion by Rumpza, second by Grebel, to approve permit for Adam Jorgenson pending publication, motion carried. Motion to approve moving and building permits for Merrill Nelson pending publication was made by Grebel, second by Berger, motion carried.

Motion to enter into executive session at 8:58pm for legal issues was made by Grebel, second by Koepp, motion carried. Mayor Jens declared executive session over at 9:10pm.

Motion authorizing Attorney Sannes to have Tom Adams serve papers for a nuisance property was made by Moen, second by Grebel, all voting aye, motion carried.

Motion was made by Grebel to authorize Mayor Jens to negotiate with County Commissioners and States Attorney Smeins on parcels 77.28.3316A and 77.28.3316, second by Berger, all voting aye, motion carried.

Motion to approve financial reports for March was made by Koepp, second by Berger, all voting aye, motion carried. Cash receipts totaled $91,973.25; General Checking $8536.30, General Savings $262.07, Library Savings $42.33, Highway 12 Streetlight Savings $1011.86, 2nd Penny Savings $4129.02, Liquor % $1854.33, Water $9830.38, Water Savings $1.07, Sewer $9915.42, Sewer Savings $112.80, Sewer Trust $20.04, Deposits $50.00, HMGP $56,207.63.

Motion to transfer $266.59 from Christmas Light/Decoration fund into the Waubay Community FunFest fund was made by Rumpza, second by Berger, all voting aye, motion carried.

The next meeting will be held May 5, 2014 at City Hall at 6:30pm.
